About these terms
These Terms of Service (“Terms”) govern your access to and use of the Latibe website at latibe.com, the web workspace at app.latibe.com, and all related features, agents, build pipelines and documentation (together, the “Service”). The Service is provided by Latent Evolution AB, organisation number 559576-9018, Stockholm, Sweden (“Latent Evolution”, “we”, “us”).
By creating an account, accepting an invitation, or otherwise using the Service, you agree to these Terms. If you use the Service on behalf of a company or other organisation, you confirm that you have authority to bind it, and “you” refers to that organisation.
Our Privacy Policy explains how we handle personal data and forms part of these Terms.
Private beta
- Access is by invitation only. We admit participants in cohorts at our discretion, and we may limit usage, such as the number of projects, AI requests or builds.
- We may change, suspend or end the beta, or any part of it, at any time. Where reasonably possible, we will give you notice so you can export your code and data.
- We value your feedback. You may share suggestions, bug reports and ideas (“Feedback”) with us, and we may use Feedback to improve the Service without any obligation to you. Feedback does not include your project content.
- Unless we agree otherwise in writing, beta access is free of charge. We will tell you in advance if paid plans are introduced, and you will not be charged without agreeing to pricing terms.
Eligibility and accounts
- You must be at least 18 years old and able to enter into a binding contract.
- You must provide accurate account information and keep it up to date.
- You are responsible for keeping your login credentials, API keys and connected integrations secure, and for all activity under your account. Tell us promptly at contact@latibe.com if you suspect unauthorised access.
- Beta access is personal to the invited person or team and may not be resold, shared or transferred without our consent.
The Service
Latibe is a self-service software platform that uses AI agents and automated build pipelines to help you scope, design, generate and compile native mobile applications. Depending on your configuration, the Service may:
- run interactive voice and chat sessions to capture and refine your requirements;
- propose architectures, dependencies and data models;
- generate, modify and commit source code and assets to repositories you connect; and
- compile builds (such as Android debug APKs) for testing on your own devices.
You control which actions the Service takes on your behalf in connected services, and you are responsible for reviewing them.
Your content and generated output
Ownership
As between you and us, you keep all rights to the ideas, specifications, prompts, files and other material you submit (“Input”). To the extent permitted by law, you also own the code, assets, builds and other material the Service generates for you (“Output”), and we assign to you any rights we may have in that Output. Input and Output together are “Your Content”.
Licence to us
You grant us a worldwide, non-exclusive, royalty-free licence to host, copy, process, transmit and display Your Content only as needed to provide, secure and support the Service for you, including by sending it to our sub-processors such as AI model providers. We do not use Your Content to train AI models, and we do not share it publicly.
Your responsibilities
- You must have all the rights and permissions needed to submit your Input and to let us process it, including any personal data it contains.
- AI-generated Output may be inaccurate, insecure, incomplete, or similar to material generated for others. Other users may receive similar output, and this is not an infringement of your rights. You are responsible for reviewing, testing and validating all Output before you rely on it, distribute it or publish it.
- Applications built with Latibe are your products. You are responsible for their compliance with applicable law, including data protection and consumer law, and with the policies of app stores and third-party platforms you distribute through. This includes any open-source licences that apply to dependencies included in your Output.
Acceptable use
You agree not to use the Service to:
- violate any law or any third party’s rights, including intellectual property, privacy and publicity rights;
- build malware, spyware, stalkerware, phishing tools, or applications designed to deceive, defraud, harass or surveil people without their consent;
- generate content that is illegal, sexually exploits minors, promotes violence or hatred, or otherwise violates the usage policies of the AI providers we rely on;
- probe, scan, overload or interfere with the Service or its build infrastructure, or circumvent usage limits, authentication or security measures;
- reverse engineer the Service, or extract its prompts, models or pipeline logic, except where the law expressly permits this;
- use the Service, or its Output, to build a competing AI app-generation platform; or
- run cryptocurrency mining or other workloads in our build environments that are unrelated to your application.
We may investigate suspected violations and remove content, limit features, or suspend accounts where reasonably necessary.
Third-party services
The Service integrates with third-party services, such as AI model providers, GitHub, cloud and CI infrastructure, and libraries or backends you choose for your application. Your use of a third-party service you connect is also subject to that provider’s terms. We are not responsible for third-party services, their availability, or changes they make. Where a third party restricts or ends access, features that depend on it may stop working.
Platform Credentials, Deployment Keys, and Third-Party Integrations
To enable automated compilation, backend provisioning, and store deployment, the Service may allow you to provide third-party API credentials, signing assets, and service tokens (including, but not limited to, Supabase configurations, RevenueCat API keys, Apple App Store Connect API keys (.p8), and Google Play Console Service Account credentials, collectively “Deployment Credentials”).
- Security and Storage: We encrypt and store Deployment Credentials using industry-standard security measures and process them solely to execute platform actions (such as backend setup, paywall integration, and build artifact publishing) as authorized by you.
- Your Responsibilities: You are solely responsible for: (a) ensuring you have the legal right to provide such credentials; (b) configuring credentials with the minimum required access permissions; (c) immediately revoking and rotating any credentials if you suspect unauthorized access or terminate your use of the Service; and (d) verifying all build versions, paywalls, and store releases before distribution to end users.
- Disclaimer of Deployment & Store Liability: To the maximum extent permitted by applicable law, we are not liable for any damages, unauthorized store releases, account suspensions, revenue losses, or disruptions arising from: (a) misconfigured RevenueCat paywalls or store products; (b) actions performed via your Deployment Credentials; (c) changes, outages, or enforcement actions taken by Apple, Google, Supabase, RevenueCat, or other third-party platform providers; or (d) security compromises occurring outside our reasonable control or resulting from credential management by you or third parties.
Our intellectual property
The Service, including its software, agents, prompts, pipelines, design, documentation and the Latibe name and logo, is owned by Latent Evolution AB or its licensors and is protected by intellectual property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable right to use the Service during the beta for your own internal purposes. All rights not expressly granted are reserved.
Confidentiality
We treat Your Content as confidential, and we access it only to provide and support the Service, to keep it secure, or where required by law. During the beta you may receive non-public information about the Service, such as unreleased features, roadmaps and performance details. You agree not to disclose this information without our permission, except to the extent it becomes public through no fault of yours.
Suspension and termination
- You may stop using the Service and delete your account at any time.
- We may suspend or end your access with reasonable notice, for example when a beta cohort or the beta itself ends. We may do so immediately if you materially breach these Terms or if this is needed to protect the Service, other users or third parties.
- When your access ends, your right to use the Service stops. Code already committed to your own repositories stays yours. We will give you a reasonable opportunity, normally at least 30 days, to export Your Content, unless the termination is due to your serious breach or the law prevents it. After that, we delete it as described in our Privacy Policy.
- Sections that by their nature should survive termination continue to apply. These include Your Content, Our intellectual property, Confidentiality, Disclaimers, Limitation of liability and Governing law.
Disclaimers
To the maximum extent permitted by law, the Service and all Output are provided “as is” and “as available”, without warranties of any kind, whether express or implied. This includes warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy and uninterrupted or error-free operation. We do not warrant that Output will compile, function as intended, be free of security vulnerabilities, or be accepted by any app store.
Limitation of liability
To the maximum extent permitted by law:
- neither party is liable for indirect or consequential loss, including loss of profit, revenue, data, goodwill or business opportunity; and
- to the maximum extent permitted by applicable law, our total aggregate liability arising out of or relating to the Service or these Terms is limited to the lesser of: (a) the total amounts actually paid by you to us for the Service in the twelve (12) months before the event giving rise to the claim, and (b) SEK 1,000.
Nothing in these Terms limits liability for gross negligence, wilful misconduct, fraud, or any liability that cannot be limited under applicable law. You remain responsible for keeping your own backups of Your Content, for example in your connected repositories.
You will indemnify us against third-party claims arising from Your Content, from applications you build and distribute with the Service, or from your breach of these Terms.
Changes to these terms
We may update these Terms as the Service evolves, for example when the beta ends or paid plans are introduced. We will post the new version here and update the “Last updated” date. For material changes, we will notify you by email or in the Service at least 14 days before they take effect, unless a change is required by law or needed to address security issues sooner. If you continue to use the Service after changes take effect, you accept the updated Terms. If you do not agree, you must stop using the Service.
Governing law and disputes
These Terms are governed by the substantive laws of Sweden, excluding its conflict-of-laws rules. The courts of Sweden shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms or the Service, with the Stockholm District Court (Stockholms tingsrätt) as the court of first instance.
If you are a consumer in the EU/EEA, you also keep the protection of the mandatory provisions of the law of your country of residence, and you may bring proceedings in the courts there.
General
- Entire agreement: these Terms and the Privacy Policy are the entire agreement between you and us regarding the Service, and they replace any prior understandings about it.
- Severability: if any provision is found unenforceable, the rest remain in effect.
- No waiver: failing to enforce a right is not a waiver of it.
- Assignment: you may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition or sale of assets.
- Force majeure: neither party is liable for delays caused by events beyond its reasonable control.
- Language: these Terms are written in English. If they are translated, the English version prevails.
